Master terms and conditions governing the use of the BookMySalonWala platform for customers and salon partners.

1. Acceptance & Intermediary Status

These Terms of Use constitute a legally binding agreement between you (“User”, “Customer”, or “Salon Partner”) and BookMySalonWala Technologies Pvt. Ltd. (hereinafter “BookMySalonWala”, “We”, or “Us”), operating the website https://www.bookmysalonwala.com and Android mobile application (Package Name: com.bookmysalonwala.app).

BookMySalonWala operates as an electronic technology intermediary under Section 2(1)(w) of the Information Technology Act, 2000. We provide digital discovery, booking management, and software tools. BookMySalonWala does not own, operate, or provide physical salon, hair, skincare, or spa services. All physical beauty and grooming services are rendered by independent third-party Salon Partners.

💳 IMPORTANT PAYMENT CLAUSE: DIRECT CUSTOMER-TO-SALON SETTLEMENT

BookMySalonWala does NOT collect, process, hold, receive, intermediate, or settle customer payments for salon appointments. Payments for all salon services are made directly by the Customer to the respective Salon Partner at the salon venue (or via salon-provided direct UPI QR codes, cash, or card swipe machines). Any dispute concerning service charges, payment receipts, or refunds must be resolved directly between the Customer and the Salon Partner.

2. Customer Bookings & Responsibilities

  • Slot Reservations: Customers may discover verified salons and reserve time slots. Customers agree to arrive punctually at the scheduled booking time.
  • No-Show & Cancellations: If a customer is unable to attend an appointment, they should cancel or reschedule promptly through the platform or by contacting the salon directly. Repeated frivolous or no-show bookings may result in booking restrictions.
  • Service Pricing: Service rates, packages, and estimated durations displayed on the platform are provided directly by salon partners. Salon partners are responsible for honoring listed menu rates.

3. Salon Owner Accounts & SaaS Subscriptions

  • Account Registration: Salon owners authenticate via secure Google Sign-In and register their salon profile, services, team members, operating hours, and location.
  • Software Subscriptions: To accept online bookings and unlock booking management features, salon owners subscribe to a SaaS software subscription tier. Subscription fees pay for software platform access and tools.
  • Subscription Cancellation & Renewal: Salon owners may manage, upgrade, or cancel software subscriptions at any time via the Salon Owner dashboard. In accordance with digital SaaS policies, subscription cancellations take effect at the end of the current billing period.

4. Eligibility & Account Security

You must be at least 18 years of age and capable of entering into legally binding contracts under the Indian Contract Act, 1872. You agree to provide accurate, current information and maintain the security of your device and login credentials.

5. Prohibited User Activities

Users shall not:

  • Make fraudulent or frivolous bookings with no intention of attending.
  • Post defamatory, abusive, offensive, or false reviews regarding salons or staff.
  • Attempt to scrape, reverse engineer, or compromise the security of the Platform.
  • Misrepresent salon pricing, qualifications, or service capabilities.

6. Disclaimers & Limitation of Liability

To the maximum extent permitted by applicable Indian law:

  • BookMySalonWala disclaims all warranties regarding the quality, hygiene, aesthetic outcome, or safety of services performed by independent salons.
  • BookMySalonWala shall have zero liability for any bodily injury, allergic reaction, property damage, or counter disputes occurring at salon premises.
  • The total aggregate liability of BookMySalonWala for platform technology failures shall be strictly limited to the lower of software subscription fees paid by the user in the past 3 months or ₹1,000.

7. Governing Law & Dispute Resolution

These Terms are governed by the laws of India. Any unresolved dispute shall be subject to the exclusive jurisdiction of the competent courts located in Maharashtra, India.
